Terms & Conditions – DariDarek

1. Definitions

For the purposes of these Terms, the following definitions apply:

Platform or DariDarek: the online platform (www.daridarek.com) through which holiday accommodations in Morocco are offered.

Guest: any individual or legal entity booking an Accommodation through the Platform.

Host: the individual or entity offering an Accommodation through the Platform.

Accommodation: the property listed by the Host.

Booking: a reservation made by the Guest via the Platform.

Services: all mediation and related services provided by DariDarek.

2. Scope of Application

These Terms apply to all use of the Platform, all Services provided by DariDarek and all Bookings made via the Platform.

By accessing or using the Platform, creating an account or making a Booking, the user agrees to these Terms.

Any deviation from these Terms is only valid if expressly agreed in writing by DariDarek.

3. Role of DariDarek

DariDarek acts solely as an intermediary between Guests and Hosts.

The rental agreement is concluded directly between Guest and Host; DariDarek is not a party to that agreement.

DariDarek is not responsible for the performance of the rental agreement, the condition or availability of the Accommodation, or the acts or omissions of Guests or Hosts.

4. Bookings and Payments

The full rental amount is payable by the Guest at the time of Booking.

A Booking becomes final once the payment has been successfully processed and confirmed to the Guest.

All prices are displayed in euro (EUR). Exchange rates, payment fees and processing times are determined by the payment service provider and are beyond the control of DariDarek.

5. Commission (10%)

DariDarek charges a commission of 10% on each confirmed Booking.

This commission is automatically deducted from the amount paid by the Guest.

The remaining 90% of the rental amount is allocated to the Host.

6. Payouts to Hosts

Payouts to Hosts are made within 30 days after the check-in date, provided that the Guest has actually checked in.

DariDarek may suspend payouts in the event of a dispute, suspected fraud or inconsistencies relating to the Booking.

Hosts are responsible for providing accurate and up-to-date payout details and bear any costs resulting from incorrect payout information.

7. Cancellation and Refunds

Cancellation by Guest:
- If the Guest cancels up to 14 days before arrival, the Guest receives a 50% refund of the total rental amount.
- If the Guest cancels within 14 days before arrival or in case of no-show, no refund will be granted.

Cancellation by Host:
- If the Host cancels the Booking, the Guest receives a 100% refund of the amount paid.

Refunds are processed via the original payment method used for the Booking, subject to the processing times and conditions of the payment provider.

8. Liability

8.1 Responsibilities of the Host
The Host is fully and exclusively responsible for:
(a) the accuracy, completeness and up-to-date nature of all descriptions, information, photos and data relating to the Accommodation;
(b) the quality, safety, hygiene, condition and legal compliance of the Accommodation;
(c) compliance with all relevant laws, regulations, permits, licences, registrations and tax obligations;
(d) any damage caused to the Accommodation or its contents by the Guest, the Guest’s visitors or any third party associated with the Guest.

8.2 Role of the Platform
The Platform provides a digital environment enabling Guests and Hosts to communicate, enter into rental agreements and complete Bookings.
The Platform is not a party to the rental agreement and has no control over the conduct, actions, omissions or communication of Guests or Hosts.

8.3 No inspections or verification
The Platform does not inspect, audit, verify or guarantee the existence, condition, safety, suitability, legitimacy or characteristics of any Accommodation.
All information displayed on the Platform is provided directly by the Host, who bears full responsibility for its accuracy.

8.4 Exclusion of liability for user-caused damage
The Platform is not liable for any damage, loss, costs or claims related to damage caused by the Guest, the Guest’s visitors or any third party to the Accommodation.
All such matters fall exclusively under the responsibility of the Guest and the Host.

8.5 Limited liability of the Platform
The Platform is only liable for direct damage that is the immediate and direct result of a failure attributable to the Platform in the performance of its own services.
In all circumstances, the Platform’s total liability per Booking is limited to the amount of commission received by the Platform for that specific Booking.

8.6 Exclusion of indirect and consequential damages
The Platform is not liable for indirect, consequential or special damages, including but not limited to:
(a) loss of profit;
(b) loss of business opportunity;
(c) loss of reputation;
(d) loss of data;
(e) business interruption;
(f) losses resulting from cancellations, double bookings or inaccurate information provided by Guests or Hosts.

8.7 Force majeure
The Platform is not liable for any failure or delay caused by circumstances beyond its reasonable control, including but not limited to:
(a) network failures;
(b) internet outages;
(c) payment provider disruptions;
(d) government restrictions or actions;
(e) natural disasters;
(f) fire, explosion or flooding;
(g) pandemics or public health emergencies;
(h) acts of war, terrorism or civil unrest;
(i) strikes or labour disturbances.

8.8 User responsibility
Use of the Platform and the conclusion of rental agreements facilitated through the Platform is entirely at the user’s own risk.

9. Privacy

Personal data is processed in accordance with the Privacy Notice available on the Platform.

By using the Platform, the user consents to such processing of personal data.

10. Intellectual Property

All intellectual property rights relating to the Platform and its content, including but not limited to the name, logo, photographs, text, software code and design, are owned by DariDarek or its licensors.

Any reproduction, distribution, modification or other use of such materials without prior written consent from DariDarek is strictly prohibited.

11. Governing Law and Jurisdiction

These Terms and any legal relationship arising out of or in connection with them are governed by Dutch law, unless mandatory law provides otherwise.

Any disputes shall be submitted to the competent court in Amsterdam, the Netherlands, unless mandatory law requires a different competent court.

12. Amendments

DariDarek may amend these Terms at any time.

The most recent version as published on the Platform applies to all new Bookings and to the continued use of the Platform.
